What is mediation?


Mediation, a type of alternative dispute resolution (ADR), is the processes of dealing with conflicts, in which the parties are active participants in the decisions required to resolve the conflict without the intervention of the court. Family law mediation pertains to mediation of divorce, custody and other family law issues.

How does a mediator help parties come to an agreement?


The mediator is neutral and helps the parties with identifying the issues, clarifying priorities, seeing past conflicts, and focusing on points of agreement. An effective mediator will help with the communication of both parties and allow them to express their anger, concerns, and misunderstandings. This environment helps reduce the hostile feelings perpetuated by a divorce and nurtures the beginning of a different type of relationship between the parties - a relationship where both parties adjust to the divorce, and plan for the future. The parties can share the cost of the mediator.

How long will this process take?


Most parties come to an agreement within one to six sessions depending upon the complexity of the issues and the readiness of the couple to mediate.

Can the mediator disclose the information discussed during the mediation session?


Mediation can be entirely confidential, unless there are safety concerns.
